noyb represents a customer of an Austrian bank, who wanted access to his bank account details – but was denied access. The Austrian DPA has decided in favor of the customer, but the bank appealed to the Federal Administrative Court (BVwG).
In essence the bank argued, that the (free) right to access under GDPR is overridden by banking regulations that allow banks to charge extra fees for any additional information.Therefor they are entitled to charge € 30 per year for access to the customer’s personal information that is not available through their online banking system.
